INDEMNITY AGREEMENT

This Indemnity Agreement ("Agreement") is entered into between Legacy Journey Tours and Events ("the Company") and the Participant ("you" or "the Participant"). By booking or participating in any tours, events, or activities provided by the Company, you agree to the following terms and conditions:

1. General Indemnity

​

You agree to indemnify, defend, and hold harmless Legacy Journey Tours and Events, its officers, employees, agents, contractors, and third-party service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of:

• 1.1. Your participation in any tour, event, or activity organized by the Company;

• 1.2. Any injury, illness, or death sustained during participation;

• 1.3. Damage to property caused by you or your behavior;

• 1.4. Any breach of these terms by you.

2. Third Parties

​

• 2.1. The Company may use third-party service providers, such as transport operators, accommodation providers, speakers, activity coordinators, and product suppliers to deliver services. While the Company ensures these providers meet certain standards, it is not liable for any act, omission, negligence, or default of these third parties.

• 2.2. You acknowledge that any claims, disputes, or losses involving third parties must be addressed directly with those providers and not the Company.

3. Cancellations and Refunds

​

• 3.1. Participant Cancellations:

1. All cancellations must be made in writing to the Company.

2. Cancellation fees may apply as outlined in the specific booking terms.

3. Refunds, if applicable, will be processed according to the Company’s refund policy and may exclude non-refundable deposits or payments made to third parties.

• 3.2. Company Cancellations:

1. The Company reserves the right to cancel any tour or event due to unforeseen circumstances, including, but not limited to, weather, safety concerns, or insufficient participation.

2. In such cases, the Company will offer an alternative tour/event or a full refund.

• 3.3. The Company is not liable for any additional costs, such as travel fees, visa fees, or accommodation, resulting from cancellations.

4. Payments

​

• 4.1. Full payment is required by the due date specified at the time of booking. Failure to make payments on time may result in cancellation of your booking without refund.

• 4.2. Payment plans, if offered, must be adhered to strictly. Late or incomplete payments may incur penalties or cancellation of your booking without refund.

5. Participant Behavior

​

• 5.1. Participants are expected to always behave respectfully and responsibly. This includes adhering to the laws and customs of the destination, following the instructions of guides or event organizers, and respecting fellow participants.

• 5.2. The Company reserves the right to remove participants from tours or events without refund if their behaviour is deemed disruptive, dangerous, or inappropriate.

• 5.3. You are liable for any damages caused by your behavior, whether to property, the Company, or other individuals.

6. Assumption of Risk

​

• You acknowledge that participation in tours, events, and activities involves inherent risks, including, but not limited to, injury, illness, loss, or damage. By participating, you voluntarily assume all such risks and fully release the Company from liability permitted by law.

7. Governing Law

​

• This Agreement shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the district court.

8. Acceptance

​

• By participating in any tour, event, or activity organized by Legacy Journey Tours and Events, you confirm that you have read, understood, and agreed to the terms and conditions outlined in this Indemnity Agreement.
